Terms of Service

These Terms govern the use of the FEELIT STUDIOS online store, available at feelitstudios.pl, including placing orders, concluding sales contracts, preorders, payments, delivery, withdrawal from the contract, and complaints.

§ 1. Definitions

  1. Seller: Bartosz Ormanin, conducting sole-proprietor business under the name FEEL IT BARTOSZ ORMANIN, ul. Starogardzka 41a, 83-240 Lubichowo, Poland, Tax ID (NIP): 5922289804, REGON: 522532365, operating the FEELIT STUDIOS online store.
  2. Store: the FEELIT STUDIOS online store operated by the Seller at feelitstudios.pl.
  3. Customer: a natural person, legal person, or organizational unit placing an Order in the Store.
  4. Consumer: a Customer who is a natural person entering into a legal transaction with the Seller not directly related to their business or professional activity.
  5. Entrepreneur with consumer rights (PPK): a natural person entering into a contract directly related to their business activity where the contract is not of a professional nature for that person. Provisions concerning Consumers apply accordingly to such persons to the extent provided by law.
  6. Product / Goods: a movable item (including apparel and accessories) available in the Store.
  7. Preorder: a special sales mode for a Product not yet in stock, shipped on an estimated date indicated in the Store, after production is completed.
  8. Order: the Customer’s declaration of intent to conclude a Sales Contract.
  9. Sales Contract: a contract concluded between the Customer and the Seller via the Store.
  10. Terms: this document.

§ 2. Seller contact details

  3. E-mail is the primary channel of contact.

§ 3. General provisions and technical requirements

  1. The Seller conducts retail sales of Products via the Store and provides related electronic services (account, newsletter, order form).
  2. To use the Store you need: a device with Internet access, a current web browser, an active e-mail account, and cookies enabled to the extent necessary for the Store to function.
  3. The Customer must use the Store in accordance with the law and good practice and must not provide unlawful content.
  4. Prices in the Store are given in Polish złoty (PLN) or the local currency of the Customer’s country. For deliveries within the European Union, prices include VAT. Prices do not include delivery costs or the customs duties and import taxes applicable in the destination country outside the EU, which are paid by the Customer (see § 8).

§ 4. Customer account

  1. Creating an account is voluntary and free. Orders can also be placed without an account.
  2. To create an account the Customer completes a registration form and accepts these Terms.
  3. The Customer may delete the account at any time by contacting the Seller. Deletion does not affect contracts already concluded.

§ 5. Placing Orders and concluding the Contract

  1. The Customer places an Order by adding Products to the cart, completing the order form (delivery details, delivery and payment method), and confirming it.
  2. Before placing the Order, the Customer confirms having read these Terms and acknowledges that the Order entails an obligation to pay.
  3. In the cart the Customer sees the total price of Products; the delivery cost is shown during checkout, before the Order is confirmed.
  4. The Sales Contract is concluded when the Seller confirms acceptance of the Order by e-mail to the Customer.
  5. The Contract content is recorded and made available via the order confirmation e-mail and by making these Terms available in the Store.

§ 6. Prices, promotions and payments

  1. The binding price is the one shown for the Product at the time the Order is placed.
  2. When a price reduction is announced, the Seller indicates, next to the reduced price, the lowest price of that Product in the 30 days before the reduction (the “Omnibus” rule).
  3. Available payment methods are presented at checkout and include, in particular: card payments (Visa, Mastercard, American Express, Maestro), digital wallets (Apple Pay, Google Pay, Shop Pay), BLIK, Klarna, and PayPal. The list may vary by country and is shown at checkout.
  4. The Customer must pay within the time indicated at checkout. Failure to pay may result in cancellation of the Order.
  5. Discount codes and promotions:
    1. Discounts granted via codes or promotions (e.g. newsletter discount, quantity discounts) are conditional and individual.
    2. The newsletter discount is 5%, granted once, on the first Order, once per Customer. The code has no expiry date unless stated otherwise.
    3. Unless stated otherwise, the quantity discount (5% for 2 Products) is applied automatically in the cart to the whole Order value and may combine with the newsletter discount (which is applied by entering a code).
    4. Detailed terms of specific promotions may be set out in separate promotion rules.

§ 7. Preorders

  1. Selected Products may be offered as preorders and are clearly marked in the Store.
  2. A preorder requires full payment in advance, at the time the Order is placed.
  3. The shipping date of a preorder Product is estimated. Current information on production stage and expected shipping dates is published in the Store (in the dedicated pre-order tab) and may be shared via social media.
  4. If an Order contains both a preorder Product and an in-stock Product, the whole Order is shipped together by default, once all Products are ready. The Customer may choose to have in-stock Products shipped separately, in which case delivery is charged per parcel.
  5. Cancellation / withdrawal:
    1. A Consumer (or PPK) may withdraw from a preorder Contract under the general rules in § 9, i.e. within 14 days of receiving the Product.
    2. In addition, the Customer may cancel a preorder at any time before shipment, in which case the Seller refunds the entire amount received (including paid delivery).
  6. If a preorder cannot be fulfilled (e.g. the Product is ultimately not produced), the Seller will inform the Customer promptly and refund the full amount within 7 days of that notice.

§ 8. Order fulfilment, delivery, duties and taxes

  1. The Seller ships to most countries worldwide. Availability for a given country is verified at checkout. The Seller may decline to ship to certain countries.
  2. Available delivery methods and costs, and detailed shipping rules, are set out in the Shipping Policy in the Store. Delivery costs are shown at checkout before the Order is placed.
  3. Fulfilment (assembly and dispatch) of in-stock Products usually takes up to 3 business days, unless stated otherwise on the Product page. Preorder timelines are governed by § 7.
  4. The risk of accidental loss or damage passes to the Consumer (or PPK) upon delivery of the Product.
  5. Orders outside the EU: prices do not include import taxes, customs duties, or clearance fees in the destination country. Such charges are levied by the authorities of the recipient’s country and are paid in full by the Customer. Information about possible charges is also shown at the delivery selection stage.
  6. Uncollected or refused parcels: if a parcel is not collected and returns to the Seller and this does not constitute exercise of the right of withdrawal, the Seller refunds the price of Products less actually incurred costs (in particular the original shipping cost and the cost of returning the parcel). Re-shipping is at the Customer’s cost.

§ 9. Right of withdrawal (returns)

  1. A Consumer (or PPK) residing in the EU/EEA may withdraw from the Sales Contract without giving a reason within 14 days of taking possession of the Product.
  2. To withdraw, the Consumer sends the Seller an unequivocal statement (e.g. via the withdrawal function available in the Store, by e-mail to feelitstudios@gmail.com or using the form in Annex 1). Sending the statement before the deadline is sufficient.
  3. Upon withdrawal, the Contract is deemed not concluded. The Seller refunds all payments received, including the cost of delivery (except additional costs resulting from the Customer choosing a delivery method other than the cheapest standard method offered), promptly and no later than 14 days from receiving the withdrawal statement.
  4. The Seller refunds using the same payment method the Customer used, unless the Customer expressly agrees to another method free of charge. If a refund by the same method is impossible, it is made to a bank account indicated by the Customer.
  5. The Seller may withhold the refund until the Product is returned or the Customer provides proof of its return, whichever occurs first.
  6. The Customer returns the Product promptly and no later than 14 days from withdrawal. The direct cost of returning the Product is borne by the Customer.
  7. The Customer is liable for any diminished value of the Product resulting from using it beyond what is necessary to establish its nature, characteristics, and functioning. In such a case the Seller may reduce the refund accordingly, but does not refuse the return. Please return the Product complete, with original tags and packaging; their absence may affect the refund amount.
  8. Exclusions: the right of withdrawal does not apply, among others, to Products made to the Consumer’s specification or clearly personalized. Preorder Products in standard catalogue variants are not personalized and are subject to the right of withdrawal.
  9. Customers outside the EU/EEA: for Customers who are not consumers within the meaning of EU law (including those residing outside the EU/EEA), the return rules in the Returns Policy apply, which may in particular provide for a refund of the Product price only (without delivery costs) and return shipping at the Customer’s cost.
  10. Detailed return rules, including for non-EU Customers, are set out in the Returns Policy in the Store.

§ 10. Complaints, lack of conformity of the Product

  1. The Seller must deliver a Product that conforms to the Contract and is liable to the Consumer (or PPK) for lack of conformity under the Consumer Rights Act.
  2. The Seller is liable for lack of conformity existing at delivery and revealed within two years of that moment.
  3. In case of non-conformity, the Consumer may demand repair or replacement. If repair or replacement is impossible or excessively costly, the Consumer may declare a price reduction or withdrawal, as provided by law.
  4. Complaints should be sent to feelitstudios@gmail.com, stating the Customer’s details, a description of the non-conformity, and the demand. The Seller will respond within 14 days of receipt.
  5. The Seller does not provide a separate guarantee unless expressly stated for a given Product.

§ 11. Newsletter and early access

  1. The Customer may consent to receive the newsletter by providing an e-mail address and accepting the sign-up. Consent is voluntary and may be withdrawn at any time (e.g. via the unsubscribe link in every newsletter email).
  2. For signing up, the Customer may receive a one-time discount as described in § 6(5).
  3. Newsletter subscribers may receive early access to selected launches and drops. This is a voluntary benefit whose terms and availability may change.
  4. Data processing related to the newsletter is described in the Privacy Policy.

§ 12. Loyalty program / rewards

  1. The Seller may in the future make a loyalty program (rewards) available in the Store, allowing e.g. collecting points and exchanging them for benefits.
  2. Detailed rules of the program (earning and using points, benefits, duration) will be set out in separate program rules and will apply from the date the program is made available in the Store.

§ 13. Out-of-court dispute resolution

  1. The Consumer may use out-of-court methods of handling complaints and pursuing claims, in particular by: applying to a permanent consumer arbitration court; requesting mediation from the regional Trade Inspection inspector; or seeking help from a district (municipal) consumer ombudsman or a consumer-protection organization.
  2. Using out-of-court methods is voluntary.

§ 14. Personal data

  1. The controller of Customers’ personal data is the Seller.
  2. The rules of processing personal data and using cookies are described in the Privacy Policy available in the Store.

§ 15. Final provisions

  1. Contracts via the Store are concluded in Polish or English.
  2. The applicable law is Polish law, provided that this choice does not deprive the Consumer of protection under the mandatory provisions of the law of their habitual residence.
  3. The Terms are provided in Polish and English. In case of discrepancy, the Polish version prevails.
  4. The Seller may amend the Terms for important reasons (changes in law, payment or delivery methods, technical reasons). Orders placed before amendments take effect are governed by the previous Terms. Registered Customers will be informed of material changes by email.
  5. Matters not regulated herein are governed by generally applicable Polish law, including the Civil Code and the Consumer Rights Act.
  6. These Terms apply from 25 August 2026.
